AGREEMENT TO TERMS

By accessing and using the Saundra Davis for Virginia campaign website (the “Site”), you agree to be bound by these Terms of Service (“Terms”). These Terms apply to all visitors, users, and others who access or use the Site.

If you do not agree with any part of these Terms, you may not access the Site.


INTELLECTUAL PROPERTY RIGHTS

Campaign Materials

The content on the Site, including but not limited to text, graphics, logos, images, audio clips, digital downloads, data compilations, and software, is the property of Saundra Davis for Virginia or its content suppliers and is protected by United States and international copyright laws.

License to Use

We grant you a limited, non-exclusive, non-transferable, and revocable license to access and use the Site for personal, non-commercial purposes related to learning about the campaign, candidate positions, volunteering, or making donations.

Restrictions

You may not:

  • Modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information obtained from the Site
  • Use the Site for any commercial purpose or for any public display (commercial or non-commercial) without explicit written permission
  • Remove any copyright or other proprietary notations from the materials on the Site
  • Transfer the materials to another person or “mirror” the materials on any other server

USER CONTRIBUTIONS

User Content

The Site may allow you to post, submit, publish, or display content, including but not limited to comments, suggestions, or feedback (“User Content”). By providing User Content, you grant the Campaign a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media.

User Content Restrictions

You agree not to post User Content that:

  • Is false, misleading, or fraudulent
  • Infringes upon any patent, trademark, trade secret, copyright, or other intellectual property right
  • Is defamatory, obscene, vulgar, pornographic, profane, or indecent
  • Constitutes unauthorized political campaign activity
  • Contains viruses or any other computer code designed to interrupt, destroy, or limit the functionality of any computer software or hardware
  • Violates any applicable local, state, national, or international law or regulation

The Campaign reserves the right, but not the obligation, to monitor, edit, or remove any User Content at our sole discretion.


DONATIONS

Campaign Finance Laws

All donations to the Campaign are subject to federal and state campaign finance laws. By making a donation, you confirm that the following statements are true and accurate:

  • You are a U.S. citizen or lawfully admitted permanent resident
  • You are making the contribution from your own funds and not those of another
  • You are not a federal government contractor
  • You are at least 18 years old
  • The funds are not from a corporation, labor organization, or national bank

Donation Limits

Contributions to the Campaign are limited by state law. The maximum contribution amount per election cycle is determined by Virginia campaign finance regulations.

Refund Policy

All contributions are final and nonrefundable except where required by law or at the Campaign’s discretion.


LINKS TO OTHER WEBSITES

The Site may contain links to third-party websites that are not owned or controlled by the Campaign. The Campaign has no control over and assumes no responsibility for the content, privacy policies, or practices of any third-party websites or services. We advise you to read the terms and privacy policy of each third-party website that you visit.


DISCLAIMER OF WARRANTIES

The Site is provided on an “AS IS” and “AS AVAILABLE” basis. The Campaign makes no warranties, expressed or implied, regarding the operation or availability of the Site. We do not warrant that:

  • The Site will be uninterrupted or error-free
  • Defects will be corrected
  • The Site or the server that makes it available are free of viruses or other harmful components

LIMITATION OF LIABILITY

The Campaign, its affiliates, and their respective officers, directors, employees, and agents, shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, or goodwill, arising out of or in connection with your access to or use of the Site.


INDEMNIFICATION

You agree to defend, indemnify, and hold harmless the Campaign, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms or your use of the Site.


GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, without regard to its conflict of law provisions.


CHANGES TO TERMS

We reserve the right to modify or replace these Terms at any time at our sole discretion. The most current version will be posted on the Site with the “Last Updated” date. Your continued use of the Site after any such changes constitutes your acceptance of the new Terms.


TERMINATION

We may terminate or suspend your access to the Site immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.


SEVERABILITY

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced.


ENTIRE AGREEMENT

These Terms constitute the entire agreement between you and the Campaign regarding the use of the Site, superseding any prior agreements between you and the Campaign.
